True Story: Victor’s Secret?
A friend called me, excited. He and his wife found a home they loved and wanted to make an offer. So we wrote the offer up. While we waited for an answer, he drove by the house. Thinking no one was home, he got out of his car for a closer look. To his surprise, the Seller came out on the driveway and chatted with him awhile, then insisted on giving him another tour of the home. But here’s the odd part: the entire time the seller was just wearing his briefs! Thanks, but that’s one home tour I’d rather miss…

U.S. Cities Ranked: Where The Poorest Live
Per the 2000 U.S. Census, the poorest live in these “metropolitan statistical areas”, as measured by % of households with $200,000+ annual income:
1. 0.6% - Jacksonville, NC***
2. 0.6% - Cumberland, MD-WV
3. 0.7% - Lawton, OK
4. 0.7% - Dover, DE
5. 0.8% - Steubenville/Weirton, OH-WV
6. 0.8% - Altoona, PA
7. 0.8% - Duluth/Superior, MN-WI

HomeBUYING Question


"Gary: I am wondering if you can tell me the answer to this question. If a couple is going through a divorce, is either party permitted to purchase a new home in his or her name only prior to settling the divorce? Your input is greatly appreciated. Thank you, sincerely."

***ANSWER:
First the obligatory disclaimer: I’m not an attorney, so please verify my answer with a family law / divorce attorney.

For simplicity, I’ll assume you’re talking about your own situation.

I’m not aware of any legal restrictions against you buying a home when you’re going through a divorce.

However, you should have your soon-to-be-ex sign a quitclaim deed saying they have no interest in the property. This is critical even if the lender or title company doesn’t require it. In many states, including California, if you purchase real estate while you’re still married, your spouse has a legal interest in it. Not a good situation if you’re divorcing them.

One more thing, you want to be very careful and have a frank discussion with your soon-to-be-ex.

More than once I’ve seen a future-ex refuse to sign off at the last minute (even one who said it would be “no problem”), shattering dreams for a home purchase.

HomeSELLING Question


"Hi Gary. I know you have a lot of experience. Suppose you have multiple offers on a home you’re selling. Other than price, what do you look for to decide which offer to accept?”

***ANSWER:
Excellent question, because there is more to an offer than price.

I also look at any closing costs the seller is asked to pay, escrow period, deposit, amount of down payment amount, and the buyer’s qualifications.

And I look hard at things others might not:

The reputation of the agent and the buyer’s lender (I cannot stress this critical point enough!):

Because it is way too easy to get a real estate license, I feel much more secure if the agent is experienced or at least on an experienced team.

And for lenders, I’m very wary of a prequalification or even a (supposed) pre-approval letter from a lender I never heard of. Too many lenders print those like they’re going out of style, without doing their homework. Then they drop the ball and have the escrow delay or fall through entirely.

If you’re like many people, you’ll nod your head in agreement. But then the next time you plan to buy or sell or get a loan, you’ll just use anybody, regardless of experience, track record, or reputation.

So when your purchase/sale/loan blows up, that little sound you hear will be me saying, “I told you so”!
 


Investing or Financing Question


"What’s causing all the foreclosures in San Diego?"

***ANSWER:
People ask me this all the time. The answer has many related parts. The causes include:

1. Subprime-
Too many people with bad credit (aka “subprime” or “non-prime”) were granted home loans. Surprise: people with a poor history of paying their bills didn’t pay their mortgage. Who’d have thunk it?

2. Pay Option-
Also called the “exploding arm”, this home loan starts at a low rate for 2-3 years, then “resets” at a much higher rate. And the bulk of these are resetting ’06-’08. BTW, this IS a great loan for some people, but it’s a disaster for others.

3. No Doc(umentation) / No Verification-
Also called a “liar’s loan”. 3 easy steps: 1) Make up an imaginary income high enough to qualify for the loan you want. 2) Get the loan. 3) Default when you remember you don’t make that imaginary income and now you can’t make your payment

4. Zero Down-
Zero down means a higher loan, no money personally invested, and impossible to refinance later into a loan you can afford.

5. Intentional “Mortgage Fraud” For Profit-
What do you get when you have a scheming lender, appraiser, buyer, & seller? Often it’s a sale and loan for dramatically more than the property value. Everyone splits the extra money and nobody makes the payment.

6. Higher Rates-
Rising rates means adjustable loans go up higher and people can’t make their payment.

7. Decreased Value-
Your payment is up and your value is down. You’re “upside down”, you can’t refinance, and you probably didn’t put anything down in the first place. What do many people do? They walk away.

8. Difficult Short Sales-
As in #7 above, you’re upside down. But you DON’T want to walk away. So you try a “short sale” in which your agent negotiates with your bank for them to take less and allow a sale. But no one told you buyers would shun your home, the bank would be slow and uncooperative and unrealistic (by expecting you to get over market value when buyers are shunning your home), and your agent would give up. My unscientific, unresearched guess is that only 1/4 of short sales are successful.

9. No Financing For Your Buyer
Lenders got burned from all the crazy loans (see #1-4 above). So they swing the pendulum too far the other way and tighten up. But guess what your would-be buyer needed to buy your home?: one of those crazy loans. No loan = no buyer. It’s called closing the barn door after the horse escapes…and closing it on the horse’s neck when she tries to come back.

This whole scenario produces many winners and losers:

The losers are obviously people who lose their home or can’t buy a home.

But the winners are those who can still buy a home, often for 10-20% below September 2005 prices. You’ll find bargains like these predominantly in the under-$800,000 range, and especially in certain neighborhoods in San Diego.
