Gone are the days of crazy loans like the “NINJA”, as in No Income, no Job, no Asset verification (“KAMIKAZE” would be more accurate, but that’s one tough acronym). Now the pendulum is swinging the other way. If you’re buying a home, be prepared for more stringent requirements on down payment, verifications, credit, etc. But there’s an upside: if you do qualify, you’ve got less competition for the home you want. Experts suspect that old pendulum will swing back a little in a few months as finance markets calm down. And we might even see the Fed cut rates a little next month. That’d be nice.

Real Estate Industry Competence at Lowest Point Ever
I keep telling you not to assume an agent or lender has a clue just because they have a license. Don’t believe me? Listen to these experts:
- “With the expansion of the number of Realtors, the level of competence has fallen to the lowest point ever,” --former NAR Chief Economist and best-selling author Dr. John Tucillo.
- “Consumers have no guarantee that anyone calling themselves a real estate agent actually knows what they are doing,” --industry consultant Jim Sherry. (I’ve actually never heard of him, but hey, he agrees with me, so he must be an expert.)

True Story: People Who Live In Glass Value-Range Houses
As I recommended value-range pricing to a client, she interrupted to say it was a dumb idea and anyone who paid over the bottom of the range was crazy. She’d have none of it…until I reminded her that when she bought the home she now wanted to sell, SHE had paid the TOP of the range. Miraculously, her opinion changed, and we went value-range…and sold the house a few weeks later.

Per the 2000 U.S. Census, the MSAs with the lowest population density, as measured by # of people per square mile (remember, Jersey City, NJ is 13,044 people per square mile):

HomeBUYING Question


"I’m buying a home and there was only one smoke detector in the hallway. My contractor says that’s fine, but my agent says they have to be in the bedrooms. Which is correct?"

***ANSWER:
Per California law, the smoke detectors must be centrally located outside each “sleeping area” (sounds like a bedroom to me).

They only must be installed in each bedroom if you do any construction, alterations, or repairs exceeding $1,000.

BTW…If you’re selling a home, take note of this.


HomeSELLING Question


"Hi Gary. My wife and I plan to sell our home and we’re pretty sure we’re exempt from paying taxes on our gain. How does that work?”

***ANSWER:
In 1997, congress gave you and me a particularly generous tax break. IRS Code Section 121 lets you sell your principal residence and exclude all your gain up to $250,000 (individuals) or $500,000 (couples).

To qualify for this whopping tax break, you must follow three simple rules:

1. "Own 2 of 5 Years" Rule (aka “ownership test”):
You must own the home as your principal residence at least 2 of the 5 years prior to closing your home sale.

2. "Occupy 2 of 5 Years" Rule (aka “use test”):
You must use the home as your principal residence at least 2 of the 5 years prior to closing your home sale. (The 2 years need not be consecutive; e.g. you can live there for 18 months, move for a year, then move in again for 6 months.)

3. "Only Once Every 2 Years" Rule:
You must wait at least 2 years after using this exclusion to do it again.

There are exceptions to these three rules that mean you may yet be eligible for a reduced exclusion that could still cut your tax bill to zero. You may qualify if any of the following happened to you, your spouse, a family member, or a co-owner:

1. Job-related move over 50 miles
2. Health-related move
3. Unforeseen circumstances, such as death, divorce, loss of job, multiple births from the same pregnancy, etc.

As I am not a tax professional, please see a tax specialist to verify this information and answer questions particular to your situation.


Investing or Financing Question


“I see that a lot of lenders are closing. What happens if my lender goes out of business?”

***ANSWER:
Depends on if you have a mortgage already or are shopping for one.

If you have a loan, don’t get too excited. You still owe the money even if your lender goes under (duh). And you’ll likely keep paying the same people for awhile, though your loan may well be sold to another bank or entity down the road.

If you’re getting a loan, you’ve got a problem. To be safe, either go with a large direct lender or a VERY sharp mortgage broker who will make sure that he or she doesn’t take your loan somewhere that’s about to shut their doors.
