"Hi Gary. I want to be a smart buyer. I know that everyone selling a home wants the highest price. Any creative ideas on how to make my offer stronger w/o just raising the price?"

***ANSWER:
While top dollar is most sellers’ #1 priority, finding a well-qualified buyer is also important, especially now with all the turbulence and disappearing loan programs in the lending markets.

So I suggest you do this:

1. Get your financing from a well-known, trusted bank.

2. Get a real “underwritten” approval, not some loan agent’s own meaningless and bogus “approval”.

3. Have that pre-approval letter show your high FICO score.

4. Provide bank statements showing proof of your down payment.

HomeSELLING Question


"Hi Gary: My friend bought a home a year ago. He's getting ready to refinance it so he can get money to pay off other debts. After he refinances he's going to sell and get another place. I told him he'd have to pay taxes because he's had it less than 2 years. But he said he won't have any capital gains because when he sells he'll get just enough to pay off the loan. Who's right?"

***ANSWER:
You are.

Capital gains has nothing to do with "net proceeds" from a sale. Otherwise everyone would do what your friend is proposing: refinance to the hilt, then sell and net nothing. Voila: no taxes! Sorry, that won't work.

Here's the basic formula to determine taxable gain:

Sales price today
- Selling costs
- Improvement costs (remodels, additions, etc)
+ Partial sale (e.g. if you sold off part of your lot)
- Purchase price (when you bought)
- Purchase costs
---------------------------------------------
= Taxable profit

As you can see, the loan amount and net proceeds are not part of the equation to determine taxable gain.

Now there could be a whole other set of reasons your friend could avoid paying tax. If he, a co-owner, or an immediate family member has had an unexpected event occur, such as loss of job, job transfer, health problems, etc., he may be able to exclude some or all of his gain. The rules are too lengthy to go into detail here.

As I am NOT a tax professional, I'm obligated to advise you, your friend, and all our Q&A subscribers to seek the advice of one.


Investing or Financing Question


"Hi Gary. I’m selling my home and my agent told me that my buyer just got what she called ‘loan approved with conditions’. My agent said she doesn’t know exactly what that means and told me not to worry about it. What does that mean?"

***ANSWER:
Yours is a simple question. And if your agent doesn’t know the answer, that’s scary.

“Loan approval with conditions” means what is says: The bank has approved the loan provided certain conditions are met.

You might say there are 2 kinds of conditions: Housekeeping items vs. “real” conditions.

Housekeeping items are nothing to worry about. They include things like:

- Borrower to sign tax return
- Need proof of insurance
- Need copy of preliminary title report or escrow instructions

But “real” conditions can be cause for concern. They include things like:

- Borrower to sell car (I’ve actually seen this!)
- Borrower to provide attorney opinion letter regarding HOA lawsuit
- Borrower is $26,000 short to close. Buyer to verify additional down payment funds.

A good loan representative takes care of most possible “real” conditions up front so they’re not a problem.

So be sure you use a good “loan rep”. If you need one, I know a great one. Just call me at 858-457-KENT.
