Seven people referred to me this week. Thank you! …Have you noticed mortgage
rates going down the past week? Hopefully the Fed lowers the discount rate next
week and mortgage rates drop further. …My 125-amp breaker blew Saturday before
Labor Day. I called Citywide, a 24-hour emergency electrician firm in the yellow
pages. No way I could be w/o power those three scorching days (remember how dang
hot it was?). They had me, and charged me a whopping $940. My regular
electrician said a fair price was $300.
Scam Warning To Business Owners!
“SEO Marketing” of Houston, TX, faxed me a bill for $79.99. Thing is, I
don’t use them or owe them any money. It’s a scam. This scam is similar to other
bogus internet and yellow pages bills I’ve received via mail. My advice: be
careful before you pay bills, even if they sound vaguely familiar…that’s because
they try to make them sound vaguely familiar!
True Story: Legal
Extortion
In California, residential real estate developers and condo-converters are
liable for certain defects for 10 years. In the 80s, this led to incredible
stories of alleged abuse and legal extortion. Back then, I even know of
attorneys actually buying condos for the sole purpose of tearing them apart to
find a defect they could push the Condo Association to sue the developer for.

HomeBUYING Question
"How can I tell if the market is
slowing down or speeding up?"
***ANSWER:
One way is by looking at changes in the “absorption rate”.
Absorption rate is defined as “the number of months (or weeks) it would take to
sell the current inventory of homes at the present rate of sales.”
To determine the absorption rate, you need to know 2 figures:
1) How many listings are currently on the market?
2) How many listings closed escrow the last three months?
Divide the number of active listings by the average number of listings that
closed the past three months. That’s your absorption rate.
For example. If there are 100 homes for sale in a certain area and an average of
5 sold the last three months, that’s an absorption rate of 20 months.
Your next question is probably, “what’s a normal absorption rate?”.
I’d love to answer that for you, but I haven’t been tracking it. My GUESS is
right now it’s between 5 and 15 months.
I do know that in the “good old days” a few years ago, the absorption rate would
have been measured in weeks, not months.
HomeSELLING Question
"I’m thinking of selling my condo
in UTC. What do you think of using a discount broker?”
***ANSWER:
Funny you should ask.
I recently received an offer from a well-known discount brokerage that shall
remain nameless. Let me share my experience:
1. The agent never called to say she had an offer. It just appeared on my fax.
2. There was no fax cover sheet and I could only make out her name with a
magnifying glass and some guesswork.
3. The offer had no deposit. (1% of the price is common.)
4. She forgot to fill in the financing. I didn’t know if it was all cash, zero
down, or ???
5. She made various other mistakes in the offer.
6. When I called the agent, her office voicemail didn’t work.
7. When I finally got through to her voicemail, there was no name identifying if
I’d reached the right voicemailbox or not.
8. She never returned a single call I made to her.
9. Due to her poor efforts, her offer was not accepted.
I’m by no means saying that all discount brokers are this bad. What I’m saying
is…
…You get what you pay for.
Investing or Financing Question
"I had an offer in
on a condo downtown, but I pulled out when I was told the HOA is suing the
developer. Is that common?"
***ANSWER:
Yours isn’t an investing question, but my answer is for investors and anyone
wanting the best value on a condo.
California is the “litigation state”. People sue for any reason.
As you read above, real estate developers and converters are on the hook for 10
years. The result is that many complexes built or converted in the past 10 years
are in litigation.
And such litigation is a big turn-off to buyers fearing physical defects and an
increase in monthly HOA dues. Further, many lenders won’t even loan in complexes
with litigation, or at least they require bigger down payments.
The net result is that litigation can quickly jolt the value of a condo,
especially in this market. An instant drop of 5%-10% is not uncommon, even if
the litigation isn’t over a major defect.
So here’s a clever bit of advice. (At least I think it’s clever.)
Try a “contrarian play”:
Find a condo in a development with litigation. Do your homework to find out if
the defects are minor. (Remember that many “problems” are grossly exaggerated
and just legal extortion of the developer.)
Provided you can get financing, make an offer reflecting the decreased value
caused by the litigation. If the list price already reflects the litigation,
it’ll be even easier to pick up the property for a bargain price.
Once the litigation ends, your value should recover from the effects of the
lawsuit within a year or so.
