True Story: How Times Have Changed
A couple of years ago, I listed a condo in La Jolla for a good client of mine.
That was on a Thursday. On Monday, he called sounding very alarmed and asked,
“What’s wrong?!” Startled, I asked him what he was talking about. His response:
“We’ve had the condo listed four days and don’t have any offers!”. I
explained to him that even in the hottest of markets, not all homes got offers
in the first week…

HomeBUYING Question
"Hi Gary. I made an offer on a
fixer-upper 4-bedroom house at XXXXX Street in Clairemont. It’s priced at
$455,000 and I figure it’ll take be $40,000 to fix it up,
so I offered $395,000. They flat out rejected my offer. Do you have any tips on
getting them to be reasonable and take my offer?"
***ANSWER:
Yes. Make a realistic offer!
The problem is that you’re engaging in some “fuzzy math”. Here’s what I mean:
I’ve seen the house you’re talking about. It’s worth 450K right now, today, as a
fixer-upper. In good shape, it’s worth 500K.
So you’ve found a fixer-upper priced correctly that already reflects the needed
work, but you’re again subtracting the cost of the work from the price.
You’re trying to get two bites of the same apple. More power to you if that
works and you get lucky.
But the seller is certainly not being unreasonable.
HomeSELLING Question
"How can I avoid being sued when
I sell my home?"
***ANSWER:
In California, no matter what you do, you can always be sued. But, you can
greatly DECREASE THE ODDS that you'll be sued.
Here are three of the seven ways to protect yourself (my clients get to know the
other four…sorry!):
1. Use a skilled, experienced agent or team to sell your home.
Common sense tells you that a good, experienced agent is going to navigate you
more safely through today's complex real estate transactions. (The tough
part is determining which agent is skilled and experienced.) And such an agent
will help you with #2 and #3 below.
2. Use all the legally required and recommended forms.
Incredibly, many agents literally break the law every day and don’t use all the
required forms, leaving their clients legally exposed and vulnerable. Truth be
told,
real estate is so highly regulated and complex today that it's tough to follow
all the rules. But if you’re going to be a professional, you’ve got to bite the
bullet
and comply.
3. Disclose everything completely & CORRECTLY.
We all know you can get in trouble for not disclosing a problem when you sell a
home. But did you know you can get into hot water just by the WAY you
disclose something? There you are trying to do the right thing, and as a "thank
you" you get hauled into court and have to hire an attorney! It's not fair. But
who said it would be?

Investing or Financing Question
"Hi Gary. I’ve
read you slamming mortgage brokers. I’m a mortgage broker and I do a great job
and work hard for my clients. Why don’t you say something
nice about loan brokers for a change?"
***ANSWER:
(Quick definition: Mortgage brokers go to another source to get a loan, rather
than “direct lenders” who make the loan themselves. Banks and mortgage
“bankers” make direct loans.)
I have said and will continue to say that there are many GREAT mortgage brokers
out there. And I’m sure you’re one of them.
But I’ve had my taste of W-A-Y too many bad apples over the years. Hundreds of
times over my 23 years, I’ve had lenders tell me:
“We can close in 21 days, no problem.”
OR
“The buyer is fully approved.”
OR
“The loan documents will be there in the morning.”
OR (my personal favorite)
“The buyer is solid gold, a slam dunk.”
…All when they knew it wasn’t the case, or at the very least had no basis to
really believe it and it assure me it was the case.
Why so many bad mortgage brokers? Same reasons there are so many bad real estate
agents:
1. It’s WAY too easy to get a license and start practicing.
2. Training is insufficient or non-existent (especially for agents!)
3. Some are flakes who get in for the supposed easy money and will stretch the
truth to make a deal.
So again, I want to say there are many wonderful, honest, skilled, and
experienced mortgage brokers in San Diego County.
And then there are the other 75%...
