True Story: Bed & Breakfast…Cease & Desist
Some 15 years back, two women called me because they desperately needed to sell. They’d bought a house in Pacific Beach and turned it into a lovely bed & breakfast. Things were going just grand…until they got the city notice to shut down. Alas, they neglected to check the home’s zoning, which was strictly residential and did not allow a bed and breakfast. …Now that I think about it, perhaps I shouldn’t open that sushi restaurant in my garage after all.

HomeBUYING Question


“Question: I saw a discount broker advertising, ‘Seller will ACCEPT offers between $490,000 and $550,000.’ Are they saying that correctly? It sure sounds like they’ll accept an offer for $500,000.”

***ANSWER:
You’re right. They’re NOT saying it correctly.

That broker is indeed saying they’ll ACCEPT any offers in their range.

The correct way of stating value range pricing is “Seller will ENTERTAIN offers between $X and $Y” or perhaps just “Value range $X to $Y”.

You may be asking yourself:

“So does that mean if I offered them $490,000, they’d have to accept?”

Surprisingly, the answer is no. Offer a property for sale does not create a contract or legal obligation to sell to a buyer who meets the offered price and terms.

However, the Realtor’s multiple listing service creates a binding offer of compensation to any broker who brings an offer meeting the seller’s offered price and terms.

Bottom line: you’d be out of luck, but your broker should get paid.


HomeSELLING Question


"We're going to sell our La Jolla home and talked with an agent we've known for years. She came last night and when we mentioned your name, she said not to call you because you're too busy and we'd get better service from her. But I like the idea of having a successful agent like you so I'm not so sure I buy her thinking. Give me a call."

***ANSWER:
When I started real estate in 1984, I worked the way many agents still do today. I was a jack-of-all-trades and master-of-few. I did everything:

- Knock on doors
- Call people for business
- Answer the phone
- Design marketing
- Show homes to people
- Do filing
- Fill out reports
- Handle banking
- List homes
- Take photos
- Make keys
- Order signs
- Input data in the Multiple Listing Service
- Write ads
- Check my vacant homes to be sure they’re OK
- Write and negotiate contracts
- Handle all the paperwork
- Manage the transaction and follow up on all the details
- Computer work
- etc., etc...

Though I worked 12 hours, 7 days a week, my service suffered because I was so darn busy. Finally I got a "helper", which made some difference. But because I sold few homes, my budget was too small to correctly market the homes my clients entrusted me to sell.

It’s the same Catch-22 many agents battle today.

But things are different now. Just like a doctor or lawyer, my (talented) staff handles the daily routine affairs so I'm free to work closer with clients.

My clients couldn’t care less who takes the photo, makes the brochure, or does the filing, so long as they’re done well.

So it's exactly the opposite of what that agent said:

I'm NOT too busy for the important things my clients expect from me. Because I'm fortunate to serve many clients, I can afford to give you excellent service.

And the fact that my real estate practice is currently over 80% repeat and referral business attests to that.


Investing or Financing Question


"If I buy one of your foreclosure properties, can I get the bank to give me a carpet and paint credit?"

***ANSWER:
Yes and No and Yes.

YES: Banks selling their foreclosures usually are agreeable to a credit, provided they meet their bottom line for the property.

NO: Your own lender will not allow a credit for carpet and paint.

YES: Your lender WILL allow a credit for “closing costs”, so that’s what you have to call it in the offer. Just be sure that the credit doesn’t exceed your actual closing costs. If you the seller agrees to $6,000 but your closing costs are only $5,000, you’ll only get $5,000.
