True Story: Tilt
In January, I listed a home in East County with floors so tilted and uneven that one woman who was in escrow on the home actually got motion sickness during her home inspection and cancelled the sale. We eventually sold it, of course with full disclosure of the floors.

Jose Canseco’s Home Foreclosed
Former American League MVP and tell-all author Jose Canseco has lost his Encino California home to foreclosure. Canseco explained that he walked away from his $2.5 million, 7,300-square foot home because, “I do have a judgment on my home and…it didn’t make financial sense for me to keep paying a mortgage on a home that was basically owned by someone else.”

America’s Top 10 Riskiest Real Estate Markets
Forbes.com looked at the country's 40 largest metros and combined data on foreclosures, job growth, transaction volume, and vacancy and current inventory rates to rank the riskiest markets. By these measures, Orlando has everything working against it. But Detroit still topped the list:

HomeBUYING Question


"My husband and I are planning to buy our first home and we want to make the right decision. Can you tell us which appreciates faster, a house or a condominium?"

***ANSWER:
The assumed conventional wisdom is that houses appreciate faster than condos. I don’t have any stats, but based on observation I have to disagree:

I think over the long run they both appreciate at the same rate.

I say this both from personal experience and because it wouldn’t make sense otherwise…

If House-X is 400K now and Condo-Y is 300K, people value living in House-X 33% higher. All other things being equal, it would defy logic if in 10 years House-X was 800K and Condo-Y was only, say, 400K.

That would mean that House-X was valued 100% more. Barring any demographic or home-style preference changes, that just doesn’t make sense.

Of course, because the House-X costs more than Condo-Y, if they both go up 10%, House-X will go up more dollars because its appreciation base was 10% higher to start with.

HomeSELLING Question


"I’m trying to figure out the value of my condo as I’d like to move. There’s one that’s the same model that just sold pretty low, but that was a bank foreclosure, so I’m not using that. Can you figure out the value of my condo for me?”

***ANSWER:
I’d be happy to. But let me comment on one thing…

You’re ignoring the foreclosure that sold, simply because it’s a foreclosure. That tells me you’re making one or two assumptions:

1. All/most foreclosures sell under market value and can’t be compared.
2. All/most foreclosures are in poor condition.

Regarding assumption #1:

- in neighborhoods with few foreclosures, foreclosures typically sell 1-5% under market value, so I make a small upward adjustment.

- in some neighborhoods foreclosures ARE the market, so no adjustment should be made.

Regarding assumption #2:

- true enough, foreclosures typically are in lesser condition than a home sold by Mr. and Mrs. Smith. But many foreclosures are in average or better condition. So you must approach this on a case by case basis and adjust for the condition of that specific foreclosure.

Again, I’ll be happy to determine the value of your condo. Of course I don’t charge for that as it’s part of the process of selling your home. Just call me at 959-457-KENT.


Investing or Financing Question


"Hi Gary. Do you know if you’re allowed to buy real estate in your IRA?"

***ANSWER:
Yes, and I’ve done it myself a couple of times.

You must have a self-directed retirement account with a company (aka “custodian”) that allows real estate IRAs.

And you must follow the rules, including:

1. You or your business cannot occupy the property.

2. You cannot buy a property that you, your spouse, or certain family members already own.

3. You cannot sell the property to yourself, your spouse, or certain family members.

4. You can finance the property, but it must be “non-recourse”, meaning that the property is sole security and the lender cannot go after the IRA for any loss.

5. All income and expenses from the property flow into and out of your IRA, not you personally. (i.e. You can’t pay the bills from your personal account or receive the income.)

There are additional rules, so please consult your tax professional for more info. (By the way, if your tax pro says you can’t buy real estate in your IRA, tell them to check again or go find another tax pro.)
