It’s really something to see all those flags as you drive down the street. One year, I drove through the neighborhood…but the flags were GONE. HomeBUYING Question


"Hi Gary. I’ve read in your newsletter not to try to buy a short sales because so few actually close. What if the MLS says that the short sale is already approved. Do those work out?"

***ANSWER:
Recently, one of my agents wrote an offer in that exact situation. The MLS listing said, “short sale already approved.”

But after they got into escrow, the seller’s agent discovered she could no longer reach the woman at the bank who supposedly approved the short sale and couldn’t get anyone else there to agree to it.

So our client’s home purchase fell apart.

Even when a short sale is supposedly “approved”, there is still a strong likelihood it won’t close, for several reasons:

-- 1. How “approved” was it?
It may not have been 100% approved. This could be due to exaggeration by or inexperience of the seller’s agent.

-- 2. Price.
Even if a short sale is approved, that doesn’t mean the bank will approve any price. A new buyer must pay equal to or greater than the price the bank approved.

-- 3. Transferability to a new buyer.
An approval with one buyer does not always mean an automatic approval with a new buyer.

-- 4. Approvals expire.
Short sale approvals ALWAYS have a deadline. This is primarily because the bank is approving a certain loss and that loss typically grows as time passes.

My advice?

Avoid the siren song of short sales.

They rarely sell for the advertised price and usually don’t even close…after you’ve invested lots of your time, energy, and emotion into pursuing one.


HomeSELLING Question


"Hi Gary. My husband and I have one of those adjustable loans and our payment jumped in January. We need to sell because we can’t afford the payment and won’t be able to make the June payment. How long do we have to sell before the bank forecloses?”

***ANSWER:
I’m sorry to hear about your situation. For better or worse, know that you’re by no means the only ones facing this. There are perhaps thousands of San Diegans in your situation and millions across the country.

As to how long before the bank forecloses, there are two parts to the answer. One part I can guess, while the other I can tell you almost exactly.

Part 1 – BEFORE the Notice of Default is filed

The part I can only guess is how long you have until the bank actually starts the foreclosure process by filing a Notice of Default (“NOD”). To my knowledge, in California banks have no required waiting period to file an NOD. They can file when you’re just one day late, but they don’t. Most banks wait until you’re behind 2-4 payments. The NOD often can be delayed if you communicate and work with your bank.

Part 2 – AFTER the Notice of Default is filed

Once the NOD is filed, the bank is legally required to wait three months to file a Notice of Sale (“NOS”). They then must wait another 21 days before they can sell your home at a foreclosure sale. This process can be delayed by negotiation or bankruptcy.

Summary:

60 days – usual minimum days late before banks file an NOD (often 90+)

90 days – minimum days in any 3-month period

21 days – required after NOS before the actual foreclosure sale

In round numbers, you usually have 5-8 months from the first missed payment until the bank sells your home.

So provided you have a skilled agent and price your home realistically, you definitely have time to sell…IF you take immediate action.


Investing or Financing Question


"I own a couple of duplexes and want to sell them outright and pay the taxes. Do you think I should sell them now or wait for the market to improve in a few years?"

***ANSWER:
Great question.

The market won’t be down forever, so I’m tempted to suggest that you wait. And perhaps you should.

But there’s another angle to this...

In eight months we’re going to have a new president, most likely Barack Obama or John McCain.

McCain is unlikely to change the capital gains rate. But the San Diego Union, U.S. News & World Report, and others report that Barack Obama has publicly stated he plans to raise the capital-gains tax rate from the current 15% to as high as 28%. (By the way, this is not a political statement.)

So if Obama gets in and drastically raises capital gains rates, you may have wished you’d sold and paid the lower rate.

You make the call…

NOTE: This possible increase should not affect you if you sell a rental on a 1031 Exchange or sell your home.
