True Story: Some People Just Aren’t Very Nice
In 1984 or ’85, I was new to real estate and struggling. Boy, things were tight. One day I bumped into an agent I slightly knew at the old Home Savings (now Washington Mutual) bank in Pacific Beach. I said hello, but her response wasn’t a pleasant “how are you?” or a friendly “how’s business?” Nope. She greeted me by saying, “I’m making a deposit. You must be making a withdrawal!” I.E., I’m making money and you’re a loser. Not exactly a warm and fuzzy moment. Of course, things have changed a bit since then.

HomeBUYING Question


"I know it’s a buyer’s market and there are lots of bargains out there. What do you think about buying a short sale or REO?"

***ANSWER:
(Quick definition: REO stands for “real estate owned” by a bank, aka a foreclosure.)

Let me answer you with this quick shorthand:

+++++++++++
REO, good.
Short sale, bad.
+++++++++++

You can often get good deals on REOs and usually get an response to your offer in a couple of days.

You can sometimes get good deals on short sales, but you usually have to wait several long weeks or months for an answer. And often the answer is no to your offer, or even a big fat no to the sale entirely, even if you were willing to pay more.

Against our advice, recently one of our clients wrote an offer on a short sale home listed at $405,000. The offer was accepted by the seller, subject to the bank’s approval.

After two tortured months of waiting, the bank came back and insisted not on $405,000, but a whopping over-market $485,000. The buyers walked, forewarned but still sad and disappointed.

My advice: There are plenty of REOs out there. Buy an REO and steer clear of short sales.


HomeSELLING Question



Hello Gary, I really enjoy reading your weekly newsletters with helpful advice. My question is about earnest money. I had a buyer put down $5000 of earnest money and offered a "no inspection" deal. We were 3 weeks in when she started to have hesitations. She finally said she wasn't going to buy without an inspection so my realtor suggested we allow her to do one for her own satisfaction. After the inspection, she abruptly decided to back out without giving us a chance to make any repairs or concessions.

We asked her to sign away the earnest money to us but you know that no one signs away their earnest money. We were told that eventually the earnest money would be sent to court for us to battle it out.

1) During your long career, did you ever have a situation where your seller had to try to collect on the earnest money? Were any of them successful? How did they collect?

2) In the future, is there any better way to set up the earnest money situation so that I can more easily collect on it if the buyer doesn't follow through after all the contingencies are met?

***ANSWER:
In California, escrow can only release the deposit to the buyer or seller with mutual instructions from both parties or an order from small claims court, arbitrator, or judge.

1. A couple of my homeseller-clients have indeed gone to small claims court and won the deposit.

2. Negotiating to split the money may be the easiest approach. Since the buyer must follow the same rules as the seller, the buyer may agree to "split the baby" and move on.

3. This one is very simple, if the buyer agrees in the upfront negotiations. Insert a clause saying the deposit is released to you nonrefundable upon removal of buyer's contingencies.

Investing or Financing Question


"Question. I have two loans on my home. The interest rate on the first loan just adjusted up and I’d like to get a lower payment as I can’t afford it for very long. Can I refinance the first?"

***ANSWER:
If you refinance, that means your current first loan is paid off and replaced by a new one. But if you pay off your first loan, then your second loan automatically goes into first position, which would kill the refinance.

I’m not a loan expert, but let me offer you two possibilities:

1. Try to get your first lender to “modify” your loan, i.e. lower the rate. If they agree, then your first loan isn’t paid off and your second loan is unaffected. Lenders don’t like to modify their loans, but I’ve heard that that sometimes will.

2. Contact your second to see if they’ll allow you to refinance your first. I believe the lending term is called “subordination” but I could be wrong. They might agree if your first loan is equal to or greater than the value of your home, ,meaning they’d be wiped out if the first foreclosed. I don’t know if this will work, but it’s worth a shot.
