True Story: "Oh, You Will…"
Many people ask how I came to have so many foreclosures for sale. Here’s the skinny... Knowing all markets are cyclical, when San Diego real estate was overheating in ‘04 and ‘05, I decided to hedge my bets in case things turned. I spent long hours calling every bank you’ve ever heard of and some you haven’t, asking how to get approved to sell their foreclosures. Many laughed, saying that had none nor saw any on the horizon. My response was a polite, “Oh, you’ll probably have a few.” Now it’s 3-4 years later, and I have 45 banks as clients and about 200 foreclosures in various stages of sale...

HomeBUYING Question


"I’d like to buy a foreclosure and want to plan ahead. What can I do to help get my offer accepted?"

***ANSWER:
Here’s a quick list:

1. Offer more money (obvious).
2. Get pre-approved.
3. Get pre-approved by the lender required by the bank, if applicable. I make it very clear up front to agents when my bank requires the buyer to be prequalified/preapproved by a designated lender, but most agents ignore it…to their peril.
4. Show proof of down payment funds. This is required on cash offers, and a good idea if you’re getting a loan.
5. Include a copy of your credit report…unless your credit isn’t so hot.
6. Don’t make your offer “and/or nominee” or “and/or assignee”. Banks won’t allow that as they don’t want people “flipping” the home to another buyer during escrow.
7. No offers contingent on the sale of another home, even if it’s in escrow
8. Offer a 21-30 day escrow when possible.
9. Write a “clean” offer with no unusual requests. Banks like to keep it simple when they sell their foreclosures.


HomeSELLING Question


"When I sold my house a few years ago, the buyer requested some repairs. I took care of them, but it was a big hassle. What do you think of crediting the buyer money instead?"

***ANSWER:
That’s a great idea.

While your homebuyer may not like the quality of work done on a repair, he can’t argue with the color of your money.

Credits are always my preference over making repairs.


Investing or Financing Question


"I want to buy an apartment building but I’m a little afraid the agent or seller will cook the books and my return won’t be what they say it is. What should I look out for?"

***ANSWER:
You’re smart to be cautious. Here’s a list of things I look for when I buy or represent clients buying investment property:

1. Are the rents & expenses “Pro Forma”. (I think that’s Latin for “fantasy.”) Pro Forma basically means the #s are what they “should” be, not what they actually are. Sometimes Pro Forma #’s are realistic; often not.
2. Are they using projected or actual rents?
3. Be aware that the property taxes will likely go up.
4. The insurance may go up too.
5. Often the owner does property management, on-site management, repairs, & gardening, so they don’t show on the financials.
6. Are there any rent concessions that aren’t showing. For example: “13th month free rent”?
7. Are vacancies low (or high) due to the location & time of year?
8. Which is better: low or high expenses? Low expenses could mean the building is in disrepair...or so good it didn’t need work. High expenses could mean it’s a high-maintenance property...or it was just renovated.
9. While it’s rare, watch out for completely made-up financial statements. Always look at the Schedule E. If you’re suspicious, use IRS Form 4506: "Request For Copy Or Transcript Of Tax"
